שו"ת גילוי הדעת של הרבנים בעניין השכרת ומכירת דירות לגויים

אני רב של יישוב בארץ ישראל. פנו אלי רבנים עמיתים בבקשה שאחתום על גילוי הדעת בעניין השכרת ומכירת דירות לגויים. האם מותר לי לחתום על מסמך כזה?

אל תחתום על מסמך כזה. שומר נפשו ירחק ממנו. יש להלחם מלחמת ה' נגד אלו הפונים מדרך הישר ומקטירים, לא עלינו, על במות של זדים והכוונה ללאומנות ולגזענות, או חלילה לשנאה ולמחלוקת.

התורה ניתנה להרבות שלום

על תורתנו הקדושה נאמר "דרכיה דרכי נועם וכל נתיבותיה שלום" (משלי ג 17). התפקיד של ההלכה ופוסקיה הוא להרבות בשלום ולא חס ושלום ההיפך. בגמרא למדנו (בבלי ברכות סד.) כדלקמן:

"אמר רבי אלעזר אמר רבי חנינא תלמידי חכמים מרבים שלום בעולם ... "שלום רב לאוהבי תורתך ואין למו מכשול" (תהלים קיט 165) "יהי שלום בחילך שלוה בארמנותיך" (תהלים קכב 7)".

עינינו הרואות שגילוי הדעת הרבה מחלוקת בין בני עמינו וגרם לגויים שחיים בסביבותינו ביחסי ידידות לחשוש מפנינו ואף לשנוא אותנו. אם כן איך רב יכול לחום על המסמך?!

היחס הנכון לגויים

מהתורה אנו מצווים לא פחות מאשר שלושים ושש פעמים לא להפלות נגד הזרים בתוכנו, ואביא רק שניים מהציווים:

"וגר לא תונה ולא תלחצנו כי גרים הייתם בארץ מצרים" (שמות כב 20);
"תורה אחת ומשפט אחד יהיה לכם ולגֵר הגָר אתכם" (במדבר טו 16).

בכל הדורות, כאשר גרנו בין העמים בגלות, בצל שלטון זר, הורו לנו רבנו לשמור על יחסים אדיבים ונכונים עמם (דינא דמלכותא דינא, דיני יין נסך וכו'). הכלל שהנחה את חז"ל היה לעשות דברים "מפני דרכי שלום" לדוגמא במסכת גיטין (סא.) נאמר:

"אין ממחין ביד עניי נכרים בלקט בשכחה ובפאה, מפני דרכי שלום. ת"ר: מפרנסים עניי נכרים עם עניי ישראל, ומבקרין חולי נכרים עם חולי ישראל, וקוברין מתי נכרים עם מתי ישראל, מפני דרכי שלום",

למרות שעל-פי התורה מצוות לקט שכחה ופאה נועדו לעניי ישראל, קבעו חז"ל שיש לאפשר לעניי גויים ללקט מהם, כדי שלא לגרום לסכסוכים. במילים מודרניות: אין להפלות על רקע גזעני. לתפיסה זו יסוד עמוק בתורה. רבש"ע ברא את כולנו בצלמו ובדמותו – גויים ובני ישראל כאחד (בראשית א 27). אסור להרע לאף אדם.

מנסחי גילוי הדעת טעו בהלכות חשובות

גילוי הדעת מבוסס על טעויות בהלכה וברשותכם אבהיר את דבריי אלו.

המשנה במסכת עבודה זרה (פרק א' משנה ח' וט') גורסת:

"... ואין משכירין להם בתים בארץ ישראל, ואין צריך לומר שדות; ובסוריה משכירין בתים, אבל לא שדות. ובחוצה לארץ, מוכרין להם בתים ומשכירין שדות, דברי רבי מאיר. רבי יוסי אומר, אף בארץ משכירין להם בתים, ובסוריה מוכרין בתים ומשכירין שדות; ובחוצה לארץ, מוכרין אלו ואלו. אף במקום שאמרו להשכיר, לא לבית דירה אמרו--מפני שהוא מכניס לתוכה עבודה זרה, שנאמר 'ולא תביא תועבה אל ביתך' "(דברים ז 26).

ראשית ההלכה לפי רבי יוסי המתיר השכרת בתים לגויים אף בארץ ישראל (ראה שלחן ערוך יורה דעה, סימן קנא סעיף ח). אבל בעיקר יש לשים לב שהגויים של ההלכה במסכת עבודה זרה הם עובדי עבודה זרה. שכנינו הלא יהודים בארץ ישראל אינם כאלו, אלא שרובם הם מוסלמים העובדים אל אחד בדרכו של אברהם סבנו המשותף. לפי הרמ"א (שחי בסביבה נוצרית) בשלחן ערוך (סעיף י):

"והאידנא נהגו להשכיר אף לדירה כיון שאין נוהגים להכניס עבודת כוכבים בבתיהם".

כך גם פסקו מרן הראי"ה זצ"ל (שו"ת משפט כהן עניני א"י סימן פט) ומרן הרב עובדיה יוסף שליט"א (שו"ת יביע אומר ח"ז יו"ד סימן יב). ביביע אומר נאמר לגבי ערבים,

"בהמשך הדורות הגיעו הישמעאלים למסקנא נכונה ביחוד ה', שאין עוד מלבדו".

נפסק בשולחן ערוך (סימן קנ"א סעיף ט') שאין למכור או להשכיר לשלושה עובדי כוכבים ביחד בשכונות היהודים אבל לבודדים מותר. שוב הכוונה לעובדי אלילים ולא בני האמונה באל אחד. אבל הנה התר מפורש כן להשכיר ואף למכור לגויים עובדי אלילים, מבלי לאפשר השתלטות על שכונה שלמה, אלא פה ושם מותר (ולמאמינים באל אחד אין כלל בעיה). חבל שמי שניסח את גילוי הדעת לא הביא מהלכה זו בשלמותה אלא בחר חלקים ממנה. זאת ועוד, ברור שמי שמוכר או משכיר דירה לאדם רע או אף למשפחה לא טובה ומביא לכך לירידת ערך המקרקעין בשכונה חטא בחטא גדול כלפי שאר תושבי השכונה. בוודאי שזה בלתי אפשרי לומר, באופן גורף, שערבים הם כולם רעים. בעוונותינו הרבים יש גם יהודים רעים שכניסתם לשכונה עלולה להוריד מחירים!

הגויים של ארץ ישראל

בימינו, זכינו, בחסדי ה', לראות שמיליוני יהודים חזרו לארץ הקדושה והקימו בה ערים והשלטון בארץ בידינו. האם הערבים המוסלמים אזרחי ישראל החיים עמנו בשלום אינם נחשבים "גר ותושב" כמו בימי התנ"ך? פסק הרמב"ם שאין בימנו מעמד זה (הלכות עבודה זרה פרק י הלכה ו) ובכל זאת, לפחות יש להסיר את היחס העוין כלפי כלל הערבים ולא לחשוש מפניהם באופן גורף. כתב הרמב"ם (הלכות עבודה זרה פרק י הלכות ו-ז) לפי הפסוק "לא תחנם" (דברים ז 2),

"לא יהיה להם חן בעיניך מפני שגורם להדבק עמו וללמוד ממעשיו הרעים ואסור ליתן להם מתנת חנם אבל נותן הוא לגר תושב".

גם אם לא ניתן להעניק את המעמד של גר ותושב אין לומר על שכנים ידידותיים, שעושים מעשי חסד וצדקה – ודי להזכיר בהקשר זה את הערבים הרבים המשרתים בכוחות הביטחון או שסתם משלמים מיסים ושומרים חוק – שאסור ללמוד ממעשיהם! ממילא הפסוק "לא תחנם" ופסוקים אחרים המובאים בגילוי הדעת נאמרו בהקשר של ז' העמים שהייתה מצווה לכבוש אותם והיו עובדי עבודה זרה.

כל זה נאמר תוך ידיעה ברורה שיש מבין הערבים, ושאר הגויים, שרוצים להשמיד אותנו, לכלותנו ולנשל את ידינו מאחוזתנו הצודקת בארץ ישראל. יש לעמוד על המשמר בכל עת מפני האויב ולהפריד ככל שניתן בין מבקשי שלומינו, כן ירבו, ואויבנו, יימח שמם וזכרם.

Hevron חברון

On Monday (2 Feb 2009) afternoon I went for a short visit to Hevron just 45 km from my house. I walked up Shuhada Street, at the top I turned right went over a barrier and past an unmanned check post. Here I met families and children in the street, was offered tea and oranges, smoked cigarettes and had babies forced upon me. Here is Mohamed and his grandson. I had a long chat with him in Hebrew (he doesn't really speak it), English (barely speaks it, but a granddaughter helped us) and Arabic (mine is a shocking). From here I walked back to the older part of town.

I had a good chat with the boy sitting in the middle of this picture (mostly about the passing girls and his concern over meeting his future in laws) until these boys called me over who work in this work shop. The one in the middle actually does not work here but next door !

A friendly rowdy lot who were fascinated to speak to a Jewish Israeli. The older man (the boss?) did not speak to me but didn't mind me being in his work shop (metal work), his workers or colleagues were happy to show me around - including the pictures of Hassan Nasrallah and Saddam Hussein on the wall!

Near the Cave of the Patriarchs, there is a massive effort to reconstruct the old style of housing to provide accommodation for more than a 100 Arab Hevronites. See more here and here, it is a spectacular and very encouraging thing to see.

I walked through the old market (strictly out of bounds to Israelis, had to duck under this gate when no one was looking) and spoke to lots of people there who were excited to meet a Jewish Israeli! In the centre is Jamil, a store holder in the market, talking to Samuel and Susanne and others of the EAPPI. Samuel and Susanne (both from Sweden) patrol the streets of Hevron, just keeping an eye on things. I walked through the old market (strictly out of bounds to Israelis) and spoke to lots of people there who were excited to meet a Jewish Israeli! This is one end of the market, and this is the other

Gay and your Prejudices

PREJUDICE AGAINST GAYS

This is first question to ask gay-bashers or homophobes who uses a religious angle: "Do you have any reason, aside from personal prejudice, that you would focus on gay/lesbian issues as being worth shouting about, instead of any other "sin" that many more people violate?" I think that religious homophobes are motivated by an irreligious, irrational and emotional prejudice against homosexuality, and not real theology.

THE SOURCES

The תורה (Torah) and Judaism, say little about gays and do not prohibit anyone being gay. In fact loving other people, of either sex, is greatly encouraged (see love and respect in the Jewish sources). In ויקרא (Wayiqra, Leviticus) 18:22 and 20:13 God does prohibit ONE particular male homosexual act called, in Hebrew, משכב זכר (miskav zakhar, anal sex in English). Whether the men in question are gay or straight (eg a one-off or men in all-male environment) is irrelevant. Being gay, loving people of the same sex is not forbidden.

Mishkav Zakhar (anal sex between 2 men) is described as a תועבה (toeivah), usually translated as an abomination. In the Torah (Five Book) only two other עבירות (sins) that are referred to as toeivah:
* ויקרא (Vayikra) 26-27 uses toeivah to describe all of the sexual offences (mostly incest).
* דברים (Devarim) Deuteronomy 25:16 uses toeivah to refer to the practice of using inconsistent standards of measure.

THE HYPOCRISY

It is worth mentioning משלי (Mishley) Proverbs 6:16-19, which tells us that there are seven things that are תועבות (toeivot) abominations to God:

טז שֶׁשׁ-הֵנָּה שָׂנֵא יְהוָה וְשֶׁבַע תועבות (תּוֹעֲבַת) נַפְשׁוֹ. יז עֵינַיִם רָמוֹת לְשׁוֹן שָׁקֶר וְיָדַיִם שֹׁפְכוֹת דָּם-נָקִי. יח לֵב חֹרֵשׁ מַחְשְׁבוֹת אָוֶן רַגְלַיִם מְמַהֲרוֹת לָרוּץ לָרָעָה. יט יָפִיחַ כְּזָבִים עֵד שָׁקֶר וּמְשַׁלֵּחַ מְדָנִים בֵּין אַחִים.

1. arrogance,
2. deceitful speech,
3. spilling innocent blood,
4. letting your heart lead you to wicked thoughts,
5. being eager to do evil,
6. testifying falsely, and
7. creating discord between brothers.

Those who use the single prohibition against mishkav zachor as a license to maltreat gays, are guilty of more than one of the seven listed toeivot. The arrogance or hypocrisy of the anti gay people is apparent. Gossiping and nastiness directed at those who are gay by certain members of the community is deceitful speech and, according to the Rabbis, tantamount to spilling blood. Do I need to continue?

CHRISTIANS AND HOMOPHOBIA

Why Christians are against homosexuality is beyond my understanding. Christians do not follow the word of the Old Testament, they do not keep kosher, they work on Saturdays etc. Why are some Christians extremely particular about Leviticus 18:22? God knows.

Rabbi Gamliel is quoted in Pirekey Avoth (the Chapters of the Fathers) from about 2,000 years ago: "Be careful of those in authority, for they will let a person near to them only for their own purposes; they act like friends when it is to their advantage, and will not stand by someone in their hour of need" (some things never change).

The Arabs and the Peace Process

Most Israelis, from a wide political spectrum, including right wing parties, are pragmatic and willing to compromise on territory in exchange for peace (or at least quiet). In short I may believe that Nablus and Hevron are ours, but for many reasons I do not want Israeli soldiers there. Sadly though, the Arabs are not willing or able to compromise. The Arab response to Israeli offers of compromise is inevitably violence. That violence has not achieved anything for the Palestinians and has probably only worsened their situation.

In 1936 Arabs rejected the offer of compromise of the Peel Commission. Never again would such a generous offer be made to the Arabs, but they rejected it and continued the violence of the Arab revolt in Palestine. It was not the first time Arab Palestinians had acted violently against Jewish Palestinians, the first major episode of violence was in 1929.

In 1947, instead of accepting the UN Partition Plan, the Arabs of Palestine, helped by neighbouring Arab countries, leashed violence against the Jews of Palestine, violence that developed into the 1948 Arab Israeli War. There is no doubt that this was the fatal mistake of the Palestinians and they are paying for this mistake to this day.

Between 1949 and 1967 Egypt illegally occupied the Gaza Strip, and Jordan likewise illegally occupied the West Bank. According to United Nations' resolutions these territories should have become a Palestinian State. Egypt or Jordan made no effort whatsoever to handover these territories to the Palestinians or to set up a Palestinian State. The West Bank and Gaza were used as launching pads for terrorist attacks on Israel.

In 1967, after the Six-Day War the UN Security Council passed Resolution 242. the Arab position as reiterated at Khartoum, remained the same: "No peace with Israel, No recognition of Israel, No negotiations with Israel" (the 3 nos of Khartoum). To get back territories captured by Israel, Egypt and Syria did not negotiate with Israel as ordered by the UN, but started the Yom Kippur War.

In 1991 Palestinians and Israelis sat together at the Madrid Conference but the Palestinians did not stop the violence of the First Intifada (which they had started in 1987) until 1993

In 2000 the Palestinians rejected the generous offers made by Israel at the critical Camp David Summit and started the horrific Second Intifada.

In August and September 2005 Israel unilaterally withdrew from all parts of the Gaza Strip. Instead of utilizing this opportunity to improve life for the 1.4 million Palestinians in the area or even to unilaterally create a Palestinian State there, the Palestinians have concentrated upon rocket and mortar attacks on southern Israel.

The true aim of the Palestinian Government and various (mostly terrorist) groups is not the end to the so called "occupation"but the removal of Jews from the whole region. The occupation is a side issue used by Palestinians to justify their rejection of a Jewish presence in the region and by some Arab states to ostracise Israel. I can easily prove this.

(1) Violence against Jews in Israel/Palestine started long before the "occupation" of the West Bank and Gaza, it started before Israel was founded.

(2) Most of the "occupation" is non-existent or ended years ago. In fact about 98% of the territory once said to be occupied by Israel is no longer occupied.

* Israel withdrew from the Sinai Peninsula under the peace agreement with Egypt.
* Israel withdrew from most of the West Bank under the Oslo Accords (although some places there are once again under occupation because of anti-Israel terrorist activity originating from there and pending further peace treaties).
* Israel withdrew unilaterally from all Lebanese territory. But still the Hizbullah's stated aim is the destruction of Israel.
* Israel withdrew unilaterally from the Gaza Strip. And today it is controlled by Hamas who call for the destruction of Israel and is the source of violence against surrounding Jewish towns.
* Israel withdrew from other parts of the West Bank under the peace treaty with Jordan.

The Arab agenda against Israel is clear and unmitigated: the use of violence to destroy Israel and remove the "alien" Jews from the area. For the Arab nationalist or Muslim fundamentalist, Zionist control of any part of Israel is occupation.

To describe the Jews in Israel as colonialists is to deny our right to be here. But for most Palestinians we are colonialists anywhere and everywhere in Israel. For the Palestinians, all of Israel is theirs, any Jew in Palestine is occupying their land, thus the ultimate aim of the Palestinian people is the removal of Jews from Palestine ie Israel.

Colonialism according to the Oxford Dictionary and Wikipedia:

"The practice of acquiring control over another country, occupying it with settlers, and exploiting it economically".
"Colonialism is the extension of a nation's sovereignty over territory beyond its borders by the establishment of either settler colonies or administrative dependencies in which indigenous populations are directly ruled or displaced".

Israel is not colonialist. The West Bank is not "another country", it is not "beyond [Israel's] borders". We are not controlling another country. In all of history there never was an Arab country called Palestine there never was a separate Arab entity in Israel. Even the Arab countries, Jordan and Egypt, that occupied the West Bank and Gaza from 1948 to 1967 did not make an Arab country (Palestine) in these territories. It is our country, at least from the Jordan River to the Mediterranean Sea: Jerusalem, Judea, Samaria, Negev, the whole country. Jews have lived in Israel for centuries. There was a sovereign Jewish state here years ago. Jews in the West Bank are living in their own country not colonizing some foreign place.

The former (Sefardi) Chief Rabbi of Israel, Eliyahu Bakshi-Doron, said once at a regional peace conference:

When I see all of the imams and rabbis coming together, this is a message to the Creator that we are here to do Your will, that is to bring peace.

The graffiti says "JEWISH ARAB BROTHERHOOD"

I subscribe to those sentiments.
